The question is what does the charter say? If it is limited to making donuts they have a problem, I suspect that it does not.

Exceptions, "A corporation is not a citizen for the purposes of the Privileges and Immunities Clause of either Article IV or the Fourteenth Amendment of the United States Constitution" [Asbury Hospital v. Cass County, N.D. 326 U.S. 207 (1945)]
