Obamacare to go before 5th Circuit
Now, explain to people who aren’t familiar with your case the argument you’re making to the court.
The argument is simply this: Obamacare was passed in violation of Article 1, Section 7 of the Constitution which requires that revenue-raising measures originate only in the House of Representatives, not in the U.S. Senate... it’s unconstitutional.
Now there have been some other cases that have gone through, but yours may have a better shot because you’re going to the 5th Circuit. Can you tell people why that is?
So the 5th Circuit is a special Circuit....Texas is willing to stand up to Washington, D.C....So Texas has always been a leader in standing up against unconstitutional things that are done in D.C.
So this case could be the end of Obamacare. If you win this one in front of a court that may be inclined your way, that could be the end of it, right?

And last question: when does this go in front of the court?
It’s going to move quickly now; briefing it should be finished by the end of February.

I heard a lot about this leading up to and after SCOTUS affirmed obamacare. Surprised it's taken this long for a challenge like this.
I'm hopeful it succeeds, but won't be sending invites for the party yet.

I am surprised as well. The 5th Circuit appellate court is the only court that has challenged Obama saying that the courts do not have the power to invalidate Obamacare. The court is saying they do have the power to invalidate anything that is unconstitutional. Get 'er done, Texas!
On a side note, I saw a very mischievous grin on Dr. Benjamin Carson's face when he stated that there are people working on a better healthcare plan and when people are ready to listen, they will present the plan.

If courts find obamacare unconstitutional, it sure can invalidate it. I want to be really optimistic about this, but I don't know that obamacare will ever be ruled unconstitutional or dismantled while obama's occupying the White House.
I hope Dr. Carson and Republicans do have an alternative. It would be a mistake to spend the last couple years trying to repeal obamacare without having an alternative ready to be unveiled. And for that matter, why wait for it? Unveil it now. JMO.

Beginning at the 4:32 marker, Dr. Carson says, "Let me just mention to you that there are some of us who are working on this and there are some VERY good ideas out there. And we are just waiting for people to be ready to hear them."

The SCOTUS could toss out Obamacare and Obama would continue to implement it. He'll simply ignore the courts like he does Congress. The HOR will then call a meeting to appoint a commission to analyze the situation.

Haha that's about right!
I can't believe Congress has rolled over and allowed obama to walk all over them and make them irrelevant to the process. Such a double standard with obama! Were it a Republican, there would be impeachment hearing in progress.
