I see people on Twitter and elsewhere claiming that this is an intrusion on Apple’s rights because it is the government forcing Apple to work for it, and to create a product that does not exist. This seems like a good argument until you think about it for a second. When law enforcement has a phone company set up a pen register or trap and trace, people at the phone company have to expend labor to comply. When law enforcement obtains a search warrant for cell phone records, a custodian of records has to work to comply.

When a Congressional committee, or a party seeking documents through FOIA, seeks Hillary’s emails, people have to work to comply. Are we saying they shouldn’t have to?

But, it is argued, Apple should not have to create a new software program for the government. I await Apple’s argument on this, as does Kerr — but such an argument seems unlikely to succeed. The features the government seeks to disable — such as the auto-erase, and the delays caused when bad passcode guesses are made — are features Apple put into their code. Creating software that turns those features off does not sound particularly hard for a company that created software to enable those features.

Why should a private company be forced to create software which allows the government to bypass their security? Especially when the government has proven it will bypass the Constitution and spy on her citizens.

Seeking THROUGH FOIA. Apple has the capability. It's about their brand and nothing else. They can extract the information and hand it over to the authorities for the good of the country. That has nothing to do with YOUR phone or MINE. It is ONE phone.

It's not just one phone. They want proprietary software so they can access any other phone they wish.

Yesterday, the government backed down and offered a compromise:

"'The Obama administration told a magistrate judge Friday it would be willing to allow Apple to retain possession of and later destroy specialized software it was ordered to create to help federal authorities hack into the encrypted iPhone belong to Syed Rizwan Farook.

.."Apple may maintain custody of the software, destroy it after its purpose under the order has been served, refuse to disseminate it outside of Apple and make clear to the world that it does not apply to other devices or users without lawful court orders," the Justice Department told Judge Sheri Pym. "No one outside Apple would have access to the software required by the order unless Apple itself chose to share it.""

""Although the judge instructed Apple to create the software for the FBI, she said it could be loaded onto the phone at an Apple facility. The Justice Department made explicit Friday that Apple could retain custody of the software at all times.""

When judging Apple here, you need to go back a year or perhaps 2 or 3 years ago when Apple announced it was encrypting its iPhones as a result of the Snowden report on warrantless spying by the government. At that time, the spooks were upset with the plans and there was even talk of legislation to force companies to put in back doors so the government could bypass when needed.

This Judge's initial order was in line with what the government ultimately wants....a back door to bypass security at any time.

Fortunately Apple resisted and now the admin says they just want Apple to brute force the phone at an Apple facility and then it can destroy the software.

I'm still skeptical because the government has an end game always, but this appears to be a good compromise.

Btw, Apple gave the government all the data from the phones cloud storage, so it's not as though they're being unreasonable.

A huge problem here.

If Apple can actually create this software, then others will know that it is possible to do.

I can see a bunch of cryptohackers getting together and creating their own version of this software and selling it in the dark net.

Ted Cruz will not win the Republican nomination. He is an unlikable weasel.
