I'm not a bit surprised that he lost in a civil court. That's the nature of this world. They should have Nike's logo stamped on their forehead - "Just Do It"!

Seriously? I have answered the same question over and over.

Of course this (similar at least) would be the scenario. Had it been a "date" or something "on the sly" it totally have been brought out in court.

In no way do I excuse his comments, however, if my wife was at a pool with one of my male friends in nothing but a bikini, I would file for divorce. In my opinion, she exercised extremely poor judgment, and showed an unhealthy willingness to mingle with a member of the opposite sex in a very volatile manner.
I do think everyone on this thread have missed the reason why Fogarty did not apologize. First, he may not have felt he did anything wrong. Second, he may have believed an apology would be viewed as an admission of guilt, and used against him in court.
Ironic, I know.

Maybe she repented and was forgiven by the time the pastor brought it public. Let's face it PO, he was not in any way looking out for anyone's interest other than his daughter's. And what do we know about the marriage other than the wife once wore a bikini? What about the husband, was he totally innocent in the divorce?

Yes you did. In fact, just last 4th of July I went swimming with a friend of mine, some mutual friends, his sister who is also a mutual friend, and also 2 girls and a guy from his youth group. All the girls had on bikinis.
There must have been a big orgy going on huh? LOL!

PO - Yes, there is more to this story. The pastor's daughter married this girl's ex-husband. This church doesn't allow divorce without an adultery reason. So if Ms. Driver had not committed adultery, his daughter would be living in sin. It's that simple.

Maybe, but no apology would have stopped the lawsuit any way.
And, for the record, I would only ever apologize for the public comments, not for feeling she committed sin.
