Yes I'm sure that there are those that are convicted unjustly, just as many more who were not convicted but were guilty as sin.

Our justice system is far from perfect, but it does strive to be just. No one is supposed to be convicted in a death penalty case where there is reasonable doubt.

Still Romans 13 seems to give clear precedents on the use of the sword by governments.

At yet there those who have been executed and posthumously proven innocent through DNA. There are those who have given confessions which years later have been proven coerced. There are witnesses who lie, and even make mistakes.

If a rapist, for example is exonerated they can be freed, restitution attempted. But what of the man wrongly executed?

There are those who have been executed and then sometimes years later proven innocent by means of DNA. Confessions have been illegally coerced, as have witnesses.

In the case of an incarcerated rapist for example, if later proven a mistake was made they can be freed and restitution attempted. How is that possible is the person has been murdered by the state? (Strong word but in this case we are speaking of the state killing an innocent protesting their innocence)

Lest I be pegged a liberal, on 99% of the issues I am not. I have been a prosecutor, juvenile prosecutor, and defense attorney, and have worked on Capital cases from both sides. Our criminal justice system is the greatest in the world, but it is not infallible.

The have been multiple instances of persons being wrongly executed and then later totally exonerated (and even posthumously pardoned!) because of DNA evidence. Confessions as well as testimony can be illegally coerced.

When a rapist for example has been proven wrongfully convicted they can be freed, and restitution attempted. The same cannot be done for one murdered by the state. (Yes I realize that is a harsh word but what else would be you the execution of an innocent proclaiming their innocence?) The problem is prevalent enough that many states now have passed laws demanded monetary compensation for wrongly convicted.

Lest I be labeled a liberal, on 99% of the issues I am not. As a former felony prosecutor, juvenile prosecutor, and one of the few who have worked Capital Murder cases from both sides I have been a little closer to this exact topic than most.

Our criminal justice system is the best in the world, and the vast majority of the time it works just as it should, but mistakes and miscarriages of justice do occur.
