because jews in the years before jesus were giving the death penalty for not tithing....
sorry, but there is no biblical support, or talmudic support for that matter, that not paying tithing is an offense worthy of death.

Tithes are quite biblical, the way tithes are being spent by today's preachers is not.
The tithes were for the support of the church, a portion went to the priests but a larger portion was for the poor and the orphans.
The tithes are to be split accordingly to this formula, first the expenses of the church, then a reasonable salary to the ministers (A mansion is not a reasonable expense), and then the rest goes to charity.

Where did Paul, James, Peter or anyone else in the NT lay how how tithing should be used in the NT church? Better yet, where did any of them instruct the NT church to tithe at all?

They didn't need to, they just continued the tradition of giving to God, they did not need to teach something that the Pharisees had already established.
Jesus himself confirmed the tithe, in his arguments with the Pharisees.
why would there be a need to teach something that had already been well taught. It would be like teaching 2 + 2 = 4 to a college graduate.

So Paul goes to foreign pagan lands and starts churches, with people who would have no knowledge of the jewish tithe tradition or law, and he just never thinks to mention it? Or perhaps you believe God imparted tithing into them supernaturally when they received the Holy Ghost? No instruction or teaching necessatry form the Apostle, they just get filled, speak in tongues and supernaturally say "hey I think we must give 10% to the church or burn in hellfire".
