Judge rules Obamascare unconstitutional.

He argues the federal government doesn't have the constitutional authority to impose the requirement.

I was getting info together to start a thread on this. Yes. Excellent news indeed. It is nice to see someone recognize that the Constitution still exists these days.

Hopefully they'll be 5 on the SC who still reconize the Constitution. I know 4 do.

I recall legislation usually contains a little clause. "if any part of this legislation is found to be un enforcible that doesn't effect any of the rest of this legislation"

I heard they forgot to put it in there. If part is found wrong, the whole thing goes in the trash?

Well the end result would be hard to call. I'm surprised to see even this much and I think I heard that an appeal is already in the works.

You work very hard in misunderstanding the law.

The way Obamascare is written, the states will have to pay for healthcare and the feds collect taxes and only partially reimburse the states.

It is clear the states can't force people to spend money to purchase things they can't afford. Remember the state didn't force you to smoke, drink, get phat and gather std's either.

This ruling was regarding the ignorant overreach of the interstate commerce clause by the libs.

I thought it was interesting that the gov. argued before the people this wasn't a tax.
When they went before this judge they argued it was a tax.
The judge wasn't buying the duplicity.
