There are no laws against being stupid, annoying, hardheaded, opinionated, or just plain foolish. There are laws, however, against criminal assault, physical assault by law enforcement against the citizens of the U.S. in direct violation of the Constitution and the general laws of the land (state and federal).
The question remains: When a representative of the government can, at their own discretion, suspend your legal rights and protections, and impose their own will upon you - and use whatever force they deem necessary to impose that will, by what term(s) would that kind of government be identified?
Assuming that the whole incident is on video tape just as the pastor describes it, and that those tapes must be surrendered to a court of law for criminal and/or civil prosecution.
Assuming for the moment that the events are true as given: What is to prevent any of us from being the next victim of governmental abuse, should anyone evoke their constitutional rights and protections? Question: Are we required to give up our rights just because we are asked to? And, if you choose not to, does that give an officer the right to inflict injuries and then arrest you?
If one has nothing to hide, why not comply with any and all requests/demands made of you? Which leads us to this: If you are a law abiding citizen, why do you need any legal/civil rights or protections at all?
Conclusion: None of us (except some terrorists) have any rights or protections left. To claim any old fashion rights of American citizenship is an admission of guilt of whatever charge made, and leaves one open to physical assault and arrest for failure to voluntarily relinquish those non-existent rights.
After all, any one of us might be next! But, if that is the case, so what?

If these video tapes are a misinterpretation of the true facts, then may the officers named by this paster sue him for every cent he has (or will ever get). And, if these public statements are in anyway a fabrication of the true events of the night in question, and if there are any laws covering such fictional ramblings, then may he go to jail for as long as the law will allow.
If the charges are true, then the officers involved need to go to jail for assault, the destruction of private property, and false imprisonment.

I agree, Michael. I don't find it funny.
For his own sake, the pastor should have just cooperated, BUT it's a sad day when we have to fear these various agencies to the point that we can't even expect our basic rights to be recognized. The bottom line is, these agencies have been given too much power, too little supervision, and no one seems to care about the constitution.
It's kind of like the case of the guy in the airport from a few weeks ago, who was detained because he had money in his suitcase. To protect himself from harrassment, he could have just went along with them, but the truth is, he should have been able to assert his rights, and have them recognized. Instead, these various law enforcers (and I use that term VERY loosely) act confused when you make reasonable requests.
A government that can't be questioned is a very dangerous entity.

I'm confused........why was there border patrol if he was going from San Diego to Phoenix? You don't even cross over into Mexico anywhere, do you? Why would he even have been stopped?
