Supreme Court upholds use of lethal injections

WASHINGTON - The Supreme Court upheld the most common method of lethal injections executions Wednesday, clearing the way for states to resume executions that have been on hold for nearly 7 months.

The justices, by a 7-2 vote, turned back a constitutional challenge to the procedures in place in Kentucky, which uses three drugs to sedate, paralyze and kill inmates. Similar methods are used by roughly three dozen states

Death penalty opponents said challenges to lethal injections would continue in states where problems with administering the drugs are well documented.

The case decided Wednesday was not about the constitutionality of the death penalty generally or even lethal injection. Instead, two Kentucky death row inmates contended that their executions could be carried out more humanely, with less risk of pain.

The inmates "have not carried their burden of showing that the risk of pain from maladministration of a concededly humane lethal injection protocol, and the failure to adopt untried and untested alternatives, constitute cruel and unusual punishment," Chief Justice John Roberts said in an opinion that garnered only three votes. Four other justices, however, agreed with the outcome.

Roberts also suggested that the court will not halt scheduled executions in the future unless "the condemned prisoner establishes that the state's lethal injection protocol creates a demonstrated risk of severe pain."



I am a bit surprised at this decision. I thought for sure they would find that lethal injections fall under cruel and unusual punishment.

Apart from the whole is-death-penalty-right-or-wrong argument... to me, there's a lot of irony in this.

So the guy who, lets say, blew somebody's head off, or hacked his wife to death with an axe, is complaining that a needle stuck in his arm is cruel and unusual punishment?

From what I have read, the fastest and most painless way to execute someone is by hanging.

Thanks ADMIN! I think what I will do from now on is post a link to the article and maybe just summarize what the article is saying. That way, we don't have to worry about those pesky copyright laws!

Or it can get botched, and become a disaster.

Like when Saddam Hussein and his cronies got hanged.
Remember how that went down? One of the men actually got decapitated in the process!

Decapitation is pretty quick too, even if it is messy and hard to watch. My opinion is that lethal injection was instituted because States wanted to be able to carry out executions without it looking like they were killing anyone. I think it would be a better deterrant to give would be criminals something visual to add to what could happen to them for committing crimes like murder. Where's the visual in going to sleep and never waking up? That's how old people die in bed. KWIM?

The whole thing is gruesome. But, as I said before, the state does have the right to bear the sword. I just don't want the thing to be done in a circus fashion or with the revenge angle being played up.

The defendant did the crime, now the defendant pays the due to the state. Only because we want the state to be better than the criminal, we won't abide the torture or exploitation that the murderer "enjoyed." Just dispatch the criminal and move on.

JMHO - I don't like it, but I'll admit to the justice of the death penalty until a better kingdom comes along.

I'm not theologically opposed to the existence of capital punishment.
Still, I do have some issues with the death penalty:

1... The rich, famous, and powerful will rarely if ever get the death penalty for crimes that would cause a poor man to get it.

2.. There's evidence of racial disparities in how the death penalty is given out.

3.. Innocent persons could end up getting executed, and it's probably happened already. People have been cleared of murder while waiting on death row... which begs the question: how many people have been executed who were actually innocent?

No one knows, of course, but anything more than zero should be cause for concern. There are documented cases of innocents being executed, but it's not possible to know how many more are just never discovered.

I am pleased with the courts decision. It was absurd to argue that lethal injection was "cruel and unusual punishment" but just the sort of absurdity that seems to happen a lot in our politically correct world these days.
