When a person is drunk they are not in their right mind. They are under the influence of a drug. Some really don't realize they are drunk, and think they drive better when they are drinking. Go figure.

So here's another question for you - if the person did their drinking at a bar, should that bar also be held responsible because they let that person leave their establishment and go out and drive?
That's part of what is coming up here in Toledo in this case. People want the bar to be held responsible. In fact, the police raided the bar after the accident (a few days later) and one of the things they found that they were not expecting to find was drugs (steroids). Oops, BUSTED!!!
This guy and his family had reserved 3 rooms at a hotel right next door to this bar for that night. He could have gone over there and slept it off. Why he drove off like that is something I don't think we'll ever know. Or understand.

I don't think the bartender should be responsible anymore than a gun dealer should be responsible for the actions of those who buy guns from them.
This kind of action will lead into frivolous lawsuits, including people suing McDonald's for their being overweight (which I think has been attempted already) or suing dealerships for accidents that were the driver's fault.

I've had two friends in two separate incidents killed my drunk drivers. My wife and daughter were hit by a drunk driver and I was behind them and came upon the scene. Both were shook up and my wife was in pain for a year. I started for the other driver with the intent to kill him with my bear hands. Two guys stepped in front of me and told me I didn't want to do that. Don't remember seeing them anymore at the scene. Several years later a friend, my son and I were hit from behind by my sister and her husband who were push into us by a drunk driver. we were stopped at a traffic light and the driver that caused the accident never touched her brakes.
I believe in mercy, but it might be a merciful thing to punish someone harshly so they do not break the law again.

About your story, however, I can just imagine how you felt. I'm a momma bear when it comes to my family, and that's how I'd react.

RevDWW, I do understand you had to feel. My mom and I were talking the other day. We commented that in the case of my niece's accident last September, which was entirely her fault and no alcohol or drugs involved at all, there is still a tendency for us to want to be angry with the semi truck driver who hit her. It wasn't even his fault. And he was definately not drinking or drugging. But it's a natural tendency.

Most state's have what is called a Dram Shop Act. A bar, and in some cases individuals can be held responsible if they continue to provide drink to one that they know or should have known was intoxicated. And that person subsequently injuries another. It is a civil action.

She got on the highway going the wrong way and hit a car head on, killing herself, her passenger and the unborn child of the female passenger in the other vehicle.
The family is suing the insurance company for the vehicle she was driving, as it was insured through her boyfriends construction company....
they are also trying to sue the bar/bartender that served her last...supposedly. Now I hear she didnt actually drink in the bar she left last, she was just there.

She could be totally blitzed out of her mind and unless you knew her, or smelled her, you'd never know it and she left the bar about 9-9:30, much earlier than the normal bar crowd. How is the bar or bartender responsible if she was KNOWN to be a very normal looking drunk?
How is the bar or bartender EVER responsible for the actions of another adult?
So please tell us... if it were up to you, what punishment would you impose on someone who drives drunk and kills multiple innocent people?
I don't know, except if it was his second + it would be very stiff. IF it was his first, I honestly don't know.

Theresa, I am in agreement with you. The only way that a bar could ever hope to enforce something keeping drunks off the road would be if they confiscated everyone's keys as they walked in the door and then made them do a breathalizer as they walked out.
Otherwise, good grief, you know they do. They'll drink till they're drunk, then go outside and stand in the aprking lot doing all kinds of whatever for who knows how long. Then maybe come back in and drink again. OR maybe get in the car and drive off.
I WISH that there was a way that bars could enforce better behavior. But the only way they could do that would be to close their doors completely and go out of business.
