questions that will be asked that will determine negligince is simple
if they got the right address would the man be alive today?
if they had clearly announced themselves would the man be alive today?
regardless of breaking the door down or not. The police mest up with the wrong address, it may not be a issue to you but im telling you its a issue.
Some one has to be accountable, a man is dead. (innocent).
let me share a story with you in nashville
a man dressed up as a Cop, had a active light, would pull people over. once he got them pulled over he would mug them at gun point.
This caused such a stir that people when getting pulled over for a minor traffic violation was calling 911 to verify that it was truely a cop pulling them over.
so yes in view of that the man who was probably asleep who was awakened at 2 in the morning could have felt threatned, cause to him why is people knocking at my door?
What are they suppose to do when a guy points a gun at them? I think there is no blame on the officers.
ooops, sorry. Wrong address, please don't shoot us in the back as we walk away.
Or maybe we are decaying back to the wild wild west. If you can get shot for snoring you will surely get shot if you accidentally wake someone up at 2am.

I, for one, am not willing to accept as gospel truth that he pointed his gun at the police. It may be true, but I guess I have seen and heard enough that I know that it is not impossible for officers to embellish when they know they screwed the pooch royally. At this point it is absolutely a matter of self-preservation. People in this case run the risk of not just getting fired, but of being convicted of a serious crime. You might be surprised what people will do to get out of a situation like that.
There are plenty of unanswered questions that unfortunately will remain unanswered. How long did they wait for someone to answer the door? I mean, if they have to wait the typical 10 to 15 seconds before breaching, yet they didnt breach, then for 2am in the morning this guy is pretty quick at waking up, getting his gun and getting to the door.....unless of course.......he was already up. Which does away with him being incoherent. . . . . unless of course..... he was on drugs. Which means he may have done exactly what he wanted to do, go out in a blaze of glory and crack. . . . unless of course......he didnt even bother to look out the window to see who was at the door so he just walk up, opened the door with a gun in his hand which is the most ignorant thing anyone could do in that situation........unless of course........................
Yeah, we could speculate all day based on our own personal distrust..right?

My point is that if you assume that every cop in every city would make this sort of mistake and just completely fall on his sword, you are either naive or oblivious. Yes, there may be some officers who would say, "we made a mistake and knocked on the wrong door, the victim answered the door, and we just saw a gun and shot him". Here I am, take me to jail" However, I know enough to know that the temptation to try to cover yourself in that situation with no eye witnesses would be great and not unprecedented. I hope there is a way to authenticate it all.

And as far as I understand he was pointing it at them.
Which is a serieus thread.
If he had the gun just in his hand on the side of his body I am sure they would not have shot him.

I'm just saying that it would not be the first time that sort of mistake was made. People have been shot because of cell phones and combs in their hands that officers thought were guns. If they thought they were dealing with the attempted murder suspect that they thought they had cornered, it is not inconceivable that the mere sight of a gun could cause at least one officer to fire. I'm sure that they already had their guns in hand and trained when they approached this guy's door.
If you think it impossible that they would say it was pointed at them to cover their tails, I have to disagree...especially when they discovered he was not the suspect after all.
