Indeed, the points made by Pel and Mizpah in these quotes are excellant. I would dare say they are too good. By that I mean, they are so good that it makes it even more apparent that the pastor was grasping at straws to justify something he knew was improper.
Had he made those points in his announcement of the new romance, no one would have debated him. And, since he would have named no specifics, only that she had 1) become (or remained?) an "unbeliever" and 2) Had departed (filed for divorce). Then there would have been no lawsuit. The fact that he ignored this easy and proper solution appears (there's the root of my favorite phrase in this thread!) that it wouldnt quite match up with the facts.

The woman in question brought the divorce proceeding and thus made the husband a "victim" of divorce. The UPC Manual very clearly delineates the propriety of such a "victim" of divorce to remarry while then asking that ministers in such a position not remarry.
The man was not a minister so he was free to remarry "only in the Lord" according to the UPCI Manual. There was simply no need for the pastor to do what he did. He could have simply read from the Manual if he wanted to "back up" the 'rights' of his daughter to date and later marry this guy.
|
Ha! So, pappa had "the manual" to give justification to his daughter for climbing into romance with this guy and he still chose the path he chose?!
All the more reason, that his board should have helped him retract his blunder and settled this thing when they had the chance. (Although, if that were the case, how many of us, incuding myself, would be asking, what's the cover up?) As it proved, it was a cool half a mill, choice.
Still, pappa's actions merit review from his supervisors and his parishoners and the UPC population at large. Not that I believe him to be a bad person, or to cause any more trouble, but because we all know how that slippery slope is. Once a person starts bearing false witness, pretty soon, they'll be....
Whew, I glad we've settled this, once and for all.

Not if he was lied to ... PO ... or exaggerated to ...
You seem to forget he was entangled in quite a web of his own doing and on the advice of a daughter and divorcee that wanted to get married sooner than later.
That it = "the bikini story" was brought up in court and the fornication charge not even remotely substantiated by the secular or spiritual definition speaks volumes that he was hanging on a straw.
As a pastor to claim personal knowledge of what was likely fabricated and adorned on the rumor mill ... shows he was unable to separate his personal bias with the job at hand.

He did use lack of wisdom in this case but I wouldn't say he is ignorant. He is very strict and conservative. There is no room for divorce except for adultery to him.

I have personal knowledge and close ties regarding another similar case regarding a Georgia UPCI woman who fell in love with a minister and was sharing their relationship and engagement on Everybody's Apostolic ... pictures and all.
The only problem was he was separated with his wife of many years .... leaving her while she was battling cancer ... with no evidence of indiscretion but later threw out accusations in order to justify his mess.
Of course, the wife also on EA found out and was quite shocked.
The wife did contact the woman and her pastor ... and nothing came of it.
Divorce was finalized ... guy got married.
A non-org Apostolic minister engaged before his divorce and relatively not one of his peers bats an eye.
The man also blamed the ex-wife for not having enough faith, or being a true Christian, in dealing with her cancer because she went to the doctor for treatment.
Guy still preaches.
