Affordable Care Act in Your State: New York

Since enactment of the Affordable Care Act on March 23, 2010, the Department of Health and Human Services has awarded $126.8 million in new grant funding in New York, and helped many residents and employers take more control of their health care – from new patient protections to new coverage options.*

◦ 153,003 Medicare Part D “Donut Hole” Rebate Checks: In New York, 153,003 Medicare beneficiaries have received a one-time, tax free $250 rebate to help pay for prescriptions in the “donut hole” coverage gap.

◦ 201 Uninsured New York Residents Enrolled in the Pre-Existing Condition Insurance Plan: This plan provides a health coverage option for consumers who have been uninsured for at least six months, have a pre-existing condition or have been denied health coverage because of their health condition, and are a U.S. citizen or are residing here legally. In New York, the Pre-Existing Condition Insurance Plan is operated by the State government.

◦$1,760,000 to Support a Consumer Assistance Program: On September 30, 2010, HHS awarded new Consumer Assistance Program grants to help strengthen and enhance ongoing efforts in the States and local communities to protect consumers from some of the worst insurance industry practices. The Department of Health in New York will receive $1,760,000 to:

◦Provide consumer assistance to at least 8,000 New Yorkers with their enrollment in coverage and/or their navigation and disputes with insurance carriers.

◦Expand accessible (walk-in) consumer assistance services to key regions in the state which currently do not have this capacity.

◦Build health care expertise and capacity in selected non-profit Community Based Organizations (CBO’s) in New York.

◦Generate meaningful reports, using program data, about consumer health issues for review with government officials and other key stakeholders and constituencies.

◦Raise consumer awareness and promote enrollment and appropriate utilization of New York’s PCIP program.

◦Expand consumer assistance services to targeted vulnerable populations (e.g. immigrants, people with disabilities, people of color and people who speak languages other than English) and underserved communities.

◦Enhance existing state services, such as hotlines, to ensure that walk-in assistance is available in key demographically and geographically underserved regions of the state.

◦$1 million to Crack Down on Unreasonable Insurance Premium Increases: New York will use the $1 million in grant funding made available to:

◦Expand the Scope of the Review Process: The grant program will be used to implement the new prior approval law passed in 2010. Under the new law all health insurance premiums will be subject to prior approval which includes adding large group review to the existing individual and small group review.

◦Improve the Review Process: Effective 2010, all new forms and revised rates are subject to the prior approval of the Department. Health insurance premiums that are determined to be unreasonable, excessive, inadequate or unfairly discriminatory cannot be approved. New York will also standardize and streamline rate filings, develop a checklist for material to be submitted in connection with future rate filings, develop specifications for more detailed market segment reporting and develop a more standardized structure for reporting claims experience.

◦Increase Transparency and Accessibility: Currently New York only posts health insurance premium rates on its website. New York plans to update its website to provide general information on the rate filing process in addition to providing a public forum in which consumers can comment on rate increases.

◦Develop and Upgrade Technology: New York will modify its existing systems and expand its data management and internal database to capture newly generated data and increase reporting functionality and establish a data center to compile and publish fee schedule information.

◦$1 million to Plan for a Health Insurance Exchange: These grants will give States the resources they need to conduct the research and planning needed to build a better health insurance marketplace and determine how their Exchanges will be operated and governed. New York will use these funds to:

◦Determine whether its current insurance regulations that go beyond the protections of the Affordable Care Act should be maintained or whether they need to be modified to limit adverse risk selection in the Exchanges.

◦Compile and evaluate background research from current research platforms and private funding by January 2011.

◦Engage stakeholders in the evaluation, planning and development process throughout the one-year planning period.

◦Evaluate the extent to which New York can or should integrate and build on existing programs, as appropriate.

◦Identify and utilize existing resources and capabilities, as appropriate, throughout the one-year planning period and determine the need for additional resources.

◦Design Exchange governance structure and draft legislation, if required.

◦Evaluate financial accounting, auditing, and reporting requirements and potential pathways to securing compliance.

◦Identify existing technical infrastructure resources and needs.
◦Create business operations plan and policies for Exchange.
◦Identify legislation and regulations needed to create, promote, and regulate the Exchange.

◦ 465 Employers Enrolled in Early Retiree Reinsurance Program: The Early Retiree Reinsurance Program (ERRP) provides much-needed financial relief to businesses, schools and other educational institutions, unions, State and local governments, and non-profits, in order to help retirees and their families continue to have quality, affordable health coverage. Find a list of organizations accepted into this program in your state here.

◦$48,014,955 in Therapeutic Discovery Project Program Tax Credits and Grants: This program was created by the Affordable Care Act to support groundbreaking biomedical research to produce new therapies, address unmet medical needs, reduce the long-term growth of health care costs and advance the goal of curing cancer within the next 30 years. In New York, this program will support 222 projects that show significant potential to produce new and cost-saving therapies, support good jobs, and increase U.S. competitiveness. This program is operated by the U.S. Department of Treasury, and a full list of small businesses participating in this program is available here.

◦Other Grants Made Available in New York:

◦$6.1 million for demonstration projects to address health professions workforce needs

◦$4.1 million for Tribal, Maternal, Infant and Early Childhood Home Visiting Programs

◦$1.7 million for Medicare improvements for patients and providers
◦$2.5 million to strengthen public health infrastructure to improve health outcomes
◦$1.7 million to build epidemiology, laboratory, and health information systems capacity
◦$2.3 million for HIV Prevention and Public Health Fund activities
◦$200,000 for State Health Care Workforce Development Grants
◦$18.7 million for the Primary Care Residency Expansion Program
◦$2.9 million for Advanced Nursing Education Expansion Program
◦$4.6 million to expand physician’s assistant training
◦$30.1 million to support capital development in health centers
◦$300,000 for the Nursing and Home Health Aides Training Program

* The list is a selection of programs funded by the Affordable Care Act and does not add up to the total Affordable Care Act funding for the State.
