Yes, he covered himself by saying that his initial shock caused him to not want to believe it was TM. Hence, Judge says it was the same answer. I'm not sure how much I find that to be likely.

It will be next to impossible for O'M to convey that to the jury.

Can the Mayor be summoned as a witness, since the tape was played in his office? I would think he should testify as to why it was played, what his office was doing in regards to the case...

One large difference between this trial and Jodi Arias' trial I watched, is attorneys from both sides are allowing witnesses to expound on an answer. In the Arias trial, the Pros Martinez demanded the witnesses hold to a yes/no answer and not elaborate on it; during this trial, witnesses have been allowed to elaborate.

It would have helped O'mara to ask a yes/no question and hold him to just a yes/no answer. O'mara didn't, and the wit was able to elaborate his excuse as to why he didn't think it was TM the first couple times he heard the tape.
