Yes I'm sure that there are those that are convicted unjustly, just as many more who were not convicted but were guilty as sin.

Our justice system is far from perfect, but it does strive to be just. No one is supposed to be convicted in a death penalty case where there is reasonable doubt.

Still Romans 13 seems to give clear precedents on the use of the sword by governments.
But as a former prosecutor, and defense attorney I can attest (and DNA affirms) that there have been wrongful executions.

If you are speaking specifically of posthumous death penalty cases I believe there are 24 to date which have been fully exonerated. And at least one that I am aware of was even posthumously pardoned.

(I apologize in advance if three or four posts on this topic pop up later. I tried multiple times to get through but apparently I find that because I am new to the forum that they were being "held for moderator review")

If a rapist for example is later exonerated they can be freed, and restitution attempted. Not the case obviously for the death penalty. Confessions can be coerced, as can witness testimony, not accounting for the fact that eye witnesses can make honest mistakes.

Lest anyone get the wrong impression, I am very conservative in 99% of my views. I am very strong law and order as well. Furthermore I sincerely believe the American system of jurisprudence, especially in criminal justice to be the best in the world. And as a veteran of more than 2,000 criminal cases (prosecution and defense) I have had a closer look than most. However, mistakes are still made.

As far as the prevelance of wrongful convictions generally, it is prevelant enough that most states now have laws demanding the monetary restitution for the wrongfully convicted.

But back to the death penalty. What percentage of murdered innocents would be acceptable? (I realize murder is a strong term, but appropriate when referring to the death of innocent person(s), would you agree?)

Daniel thank you. James is fine. My apologies in advance to the forum apparently I can get small sentences through but my posts are getting held up by administration. So once again my apologies should redundant posts show up. Would anyone object to my relaying a post through Dan? Or would that be fudging on his quest for 10,000?

I think you can post up to 1,000 characters or words?... if you go beyond just cut it in half and paste the rest into a second post.
