Hilarious ... if you see who voted which way, it was completely party-line. 60 democrats said, no we're not being unconstitutional and 39 republicans said, yes you are.

It looks like the judiciary will decide when the lawsuits start rolling in.

If anyone asked me to, I would definitely sign on to a lawsuit against this bill.

Yes, totally a party-line vote. We have NEVER passed such huge legislation on a party-line vote.

I hear the healthcare talks will be delayed until February. The abortion issue is giving them some trouble. Go Stupak!!!!!

I read that too, but the way I understood it ... the Senate will vote and pass their version tomorrow, 8AM, but the final bill - the House/Senate final version will be delayed.

At least that's the way I understood it.

I'm still hoping some Democrat either has car trouble, gets sick or is by some other means unable to make it to tomorrow AM's vote!

Right - the final bill is all that concerns me. Some have been on board to move it along for debate, not necessarily that they will vote at the end game. Stupak says they won't have the final vote.

Don't they only need 51 votes but want to have 60?

Here is the excerpt within the Healthcare Bill in question concerning the "From No Healthcare to Jail" provision:

Willful failure to comply with the individual mandates of H.R. 3962 will be penalized through enforcement of the following Internal Revenue Code:

"H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

Title 26 > Subtitle F > Chapter 75 > Subchapter A> Part I: Section 7203: misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

Title 26 > Subtitle F > Chapter 75 > Subchapter A> Part I: Section 7201: felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.”

Obama and Reid Both Double-Counted Medicare Cuts

Earlier today, the Congressional Budget Office explained that the savings generated by Democrats' proposed Medicare cuts could either be used to finance the health care bill or to extend the solvency of Medicare, but could not do both at the same time.

Put another way, Democrats cannot claim that their bill would both strengthen Medicare and decrease the defict. But that's exactly what Democrats have been claiming over the the past week.
