The Federal Defense of Marriage Act (DOMA) defines marriage as a legal union between one man and one woman for purposes of all federal laws, and provides that states need not recognize a marriage from another state if it is between persons of the same sex. 37 states have their own Defense of Marriage Acts (DOMAs), while 2 more states have strong language that defines marriage as one man and one woman. There are 30 states that have constitutional amendments protecting traditional marriage, including the three states (Arizona, California, and Florida) that passed constitutional amendments in November 2008.

It would depend on how the states decided to handle it. It could be some sort of prenuptial agreement, like a contract, that would divide the property in the event of a divorce.

But I mean who would decide what counted as grounds for a divorce. The church or the government?
EDIT: Nevermind, I guess the prenuptual agreement could include what would be grounds for separation.

Well if the church was the one doing the marriages then the church would, but then you could always go to a different church if you don't like the ruling. Marriage really isn't the issue in a divorce, the issue is always children or property.

True, but I can see to many issues arising just from questions about how divorce would work for the government to ever get out of marriage.

mARRIAGE IS THE ISSUE. Marriage is a covenant as described in most vows. The world treats it like a change of batteries. Yopu describe a very ungodly veiw toward marriage.
Don't ever let lawyers minimize it. They put money before God's plan. .
