I don't think you understand what it is like to serve the most just country on the earth right now while looking into the eyes of young men and old unfairly incarcerated by your country.
Many folks detained are very bad people and I wish they were simply killed after about the 3rd or 4th day of their capture. Their "intel value" after that point is almost zero anyway.
But I have met some who were unfairly captured. The military folks know it, the CIA know it, but once captured, there is a process involved that just is not simple at all. Often, the captured are residents of a country who's government (local) will kill them anyway, upon release from U.S. custody. Sometimes, their governments won't even allow them back into their country (nationally).
What do you do with those folks-- the innocent who can never return to their own country because of what they have been accused of?
There is a system to which EC's (enemy combatants) who are captured can be tried, but the system is pretty "new" and thus, has major flaws for example, if you are accused to be aiding the Taliban by another young man who simply wants you out of his way for whatever reason, you have virtually no recourse.
The ANA or ANP (Afghan National Army / Police) will detain you, transfer you to U.S. custody (after being beaten almost to the point of death sometimes), and then you have to wait, most times years, for a trial in the military system by a foreign government entity that has no intention of releasing you if you are going to hurt it's people or assets.
Indeed we will detain you as long as we possibly can if it means protecting American life and assets. For some folks, they think this better than killing them.
I am not one for killing the innocent on purpose. I find more appalling however, to leave the innocent and the guilty incarcerated for years and years without a trial. I think it would be better to just kill them and be done with the justice or mistake, whatever the case may be.
