I would suspect that if you are in plain view from someplace, other than by someone placing their face against your window and looking in, that it would be legal.
That's what I thought I remembered. That if you were visible from outside then there is no reasonable expectation of privacy.

Is it true that in your house you have no legal right to visual privacy? That someone could videotape through an open window curtain and you cannot prosecute?
