There is a statute of limitations on such actions, so it would depend on the situation. In addition, depending on the law, if the parents gave her permission to marry, it's not rape. There are 15 and 16 yr olds that get married legally in this country to men who are in their 20's.

It's very simple. You get each mother with their children. Ask the age of the oldest. Ask the mothers age. Subtract. If it is under the age of consent arrest the father.
From everything that I have heard so far, this is almost impossible to determine because the women are not giving their last names. And their documentation for marriages and births are almost non-existent.
In one interview I saw this morning, the woman would not say if her husband had multiple wives. They aren't talking.
DNA would be the only proof. I hope they can compel samples from everyone.

It is not ME who is saying there is no evidence. I am saying IF they do have the evidence then they should be going after the criminals - not taking mammas away from their children. (unless there is evidence that implicates a mother)
They do not have evidence yet. All they have is an allegation. A cry for help from one of them. That's it. They acted on that alone.
When they DO have the evidence, THEN they can go after the criminals. Until then they have to act on the accusation of a crime being committed.

State officials Tuesday defended their decision to suddenly separate mothers from many of the children taken in a raid on a polygamist ranch in West Texas.
Texas Children's Protective Services spokeswoman Marleigh Meisner said the separation was made Monday after they decided that children are more truthful in interviews about possible abuse if their parents are not around.
When state troopers and child welfare officials seized 416 children from the compound, 139 women accompanied them on their own and had been allowed to stay with the children until Monday, when they were driven back to the compound.
Only women with children under 5 could stay at the San Angelo Coliseum where they were being held.
Meisner said the decision was made after much discussion with experts.
Maybe, but I am sure a court would have to first nullify the marriage based on it being a multiple marriage. This is another reason why I think this whole situation is going to take years to settle in the courts. It's one to say A or B, but it is another thing entirely for what is said to carry the weight of the law behind it. So, in other words, the courts may eventually determine these underage mothers to be victims of molestation, but the court first has to establish that their marriages were never legal in the first place.
I am sure Texas has laws against bygamy. I am thinking the reason they did not take the men but the children is if they took the men without evidence it would not be legal. But if children are in harm's way they can be removed by the state. And the evidence of abuse is young girls that are pregnant or have already had babies.
