The House of Representatives passed the Local Law Enforcement Hate Crimes Prevention Act (LLEHCPA) today (249-175).
"[The vote] is a victory for those who may find themselves targeted because of the color of their skin, their gender identity, sexual orientation, gender, or disability. It is a victory for the families of victims of hate crimes – people like Angie Zapata of Colorado, Luis Ramirez of Pennsylvania, Billy Ray Johnson of Texas, and Matthew Shepard of Wyoming," said Wade Henderson, president and CEO of LCCR. "Today, the House has sent a clear message that Americans do not have to live in fear."
The LLEHCPA will authorize the Department of Justice to investigate and prosecute certain bias-motivated crimes based on the victim's actual or perceived sexual orientation, gender, gender identity, or disability. Currently, the federal government can only investigate hate crimes motivated by the victim's race, color, religion, and national origin.
Most crimes as it concerns hate crimes are gays committing acts on gays and other groups on themselves. This law over reaches in that if a preacher uses the bible and preeches against pedophilia for example and a congregant commits a crime, theis desire is to implicate the pastor. Silencing the Christian is big business in this new age.
Senate Democrats said on Monday that they would seek to broaden the federal hate crimes law to protect victims of attacks based on gender, sexual orientation, gender identity or disabilities.
To lift the chances of passage, Democrats said the legislation, known as the Matthew Shepard Hate Crimes Prevention Act, would be attached as an amendment to the annual defense authorization bill – a must-pass measure.
Just for the record. The Matt Shepherd horrible murder was reported later as NOT driven as a crime against a gay, but 2 drug addicts killing a boy for drug money. We have had several Pentecostals arrested under this type of laws in other countries.
Note. I thought the Democrats were going to surrendor and stop defense spending. I guess I mis understood their campaigns last fall.

In my law classes we did mock trials and role played cases.
This law is named the pedophile protection act. If I erase a pedophile that molests my child, i will be doubled in sentencing. You made a legal point. This erodes equal protection under the law. This is horrible lefgislation and it attached to denfense spending because democrats do not think they can pass it aniother way. It really seems the liberals are supporting the most common paraphilias.

All humans are worth the same.
But if you killed and it is proven that the basis of your killing was race, gender, etc then your punishment will be stiffer.
What's wrong with that?
If you kill someone in a drunk driving accident who happens to be some type of minority, it is obviously not a hate crime.
People who criticize these measures forget that hate crimes still occur.
For the record, I believe when a black person kills someone because of their race, orientation, etc, then they should be prosecuted under the hate crime provision as well.

I've never supported hate crime legislation. There are laws in place already against all the crimes that hate crime law is meant to deal with. IMO, a person's motive for the crime should not make a difference in the amount of time a criminal receives for murder or assault, or any other punishable crime.
The law shouldn't protect one group of citizens anymore than another. A murder is a murder, an assault is an assault, robbery is robbery....ect, etc...

Most would not be able to prove it was a hate crime. There are some exceptions, however, there are already laws to deal with criime, that should be sufficient.
This is bordering on "thought" crimes. What were they thinking when they committed the crime, was it really hate?
As the case they use to support this legislature, has proven it was not hate, but greed for money due to drugs. Which I think is an excellent example why this is a horrible bill, just because a straight person kills a gay it is automatically a hate crime. Or just because a black person kills a white person it is a hate crime. That is nonesense.

This should be outlawed where they can NOT attach anything to another bill that has nothing to do with the main bill.
I hope the line item veto can apply to the congress as it does to the president. We know this president would not strike it out.

Killing some one in a car accident is completely different from accidentally killing some one in a robberry attempt which is completely different from killing some one you know while they sleep.
The end result for all three crimes are the same.
The motivations are different.
In order for justice to be justice, the law can't be blind to the specifics of each specific situation.
That is whole reason of having laws, a courthouse, judge and jury in the first place.
Some crimes should be punished with harsher penalties if the intent is more malicious.
And for those who would argue otherwise, I guess you would be supportive of a bill that made the punishment for abortion an automatic death penalty-- after all killing is killing! Punish every one all the the same!
That's NOT justice, that's stupid.
