Police have authority to arrest, detain & restrain people who are in breach of the law of the land.

The question everybody keeps avoiding is... what law did she break?

*sigh*

There are different ordinances for every city/county, as I'm sure you're aware, but this is a start:

From http://www.ecode360.com/?custId=NO1279, Part II, General Legislation (Village of North Syracuse, NY)

Re: (Chapter 230) Vehicles and Traffic, Article IV, Enforcement,

(230-33) Compliance Required -
It shall be unlawful and, unless otherwise declared in this chapter with respect to a particular offense, it is a traffic infraction for any person to do an act forbidden or fail to perform any act required by this chapter.

(230-35)Obedience to police officers, fire police and flag persons -
No person shall fail or refuse to comply with any lawful order or direction of any police officer, fire police or flag person duly empowered to regulate traffic within the Village of North Syracuse.

(230-34) Penalties for violations of traffic regulations -
Every person convicted of a violation of 230-33 shall be subject to the same penalties as if he had been convicted of a violation of 1101 of the Vehicle and Traffic Law of the state of New York.

Vehicle and Traffic Law, section 1101 -
§ 1101. Required obedience to traffic laws. It is unlawful and, unless
otherwise declared in this title with respect to particular offenses, it
is a traffic infraction for any person to do any act forbidden or fail
to perform any act required in this title.

Ms. Harmon may not have been in this exact location, however, the point is there are similar ordinances in place in most areas, and I don't think we can just go around pretending that we don't have to comply with local law enforcement, or that there aren't consequences (and LEGAL ones at that) for failure to comply.

Indeed... it is unlawful for anyone to do any act forbidden or fail to perform any act required...

That was my question. What law did she break?

You tell me? Was the order for her to return to her vehicle a lawful order? Was it a reasonable "direction" by the police officer?

You're being obtuse, D4T. She didn't obey directions. Quit trying to prove that police are big, mean brutes. They're just doing their jobs, most of the time. Those who are proven to be abusive usually lose their jobs--just like in any OTHER profession.

Oh and for the record, it is completly plausable that the police officer thought the woman was on the phone when she was not.

it is also plausable that the police officer was wrong in stating that she was speeding.

In both cases the woman who got tazed had legal options. She could have requested that a police supervisor be directed to the scene. She could have called the police department and requested assistance... all the while complying with the direction given her by this officer.

There really are very good ways to deal with the police that will get what you need that wont end in you being tazed.

D4T, you may not LIKE the idea that the police have the authority to tell you what to do, but they do. If you feel those boundaries have been crossed, constitutionally speaking, the right place to protest them is in court or in legislation. NOT in the street while your kids are watching in the car, and not just simply for the purpose of proving the policeman isn't your "boss."

From a political standpoint, I get this argument about police brutality, although I think in many cases it is exaggerated to make a point, or deliberately provoked for the same reason. From a Christian perspective, however, we are to obey those who are in authority over us. We are to treat others with kindness--including our authorities and those in government positions. Oh, yeah--and that includes our President.

Political activism can really mess with Christian philosophies and ideals, if you aren't careful. I have a feeling if Paul were alive today, and if he were allowed an audience with the President, he wouldn't waste his time talking about healthcare reform or the condition of the roads, but rather the state of the President's heart. Nothing more, nothing less.

We need to be careful not to be distracted by worldly concerns, including politics, to the point that we lose our Christian worldview.
