Not licensed in Florida. But from what I have read I would feel pretty good about winning. No need for talk shows. But I would figure out a way to flip it and talk about my church. ;-)

Yep and like you pointed out appears immediacy issue is missing. Also I would file equal protection issues if Florida law is substantially different from other jurisdictions since Florida is the complaining witness and they ordered a book solely for the purpose of filing charges.

I think Colorado is the anomaly most states have an obscenity statute.

You are probably more current on that than I am. (Although if needed could come up to speed real fast LOL) I am just saying they made what appears to be a difficult enough case worse by adding under color of law action as element.

Smacks of publicity hound for a small jurisdiction as well.
