SoCal already posted that they most likely were contacted and signed waivers before the show; knowing that Letterman was going to talk to her. That being the case; it doesn't seem that they minded being busted.

It does not work that way. By virtue of being in the audience you agree to be recorded for television and possibly be called on by the host.

They may have had them sign some additional paperwork after the taping for details such as name, address, etc.
