Does intent matter? Yes, of course it does. Which is why the scripture in question clearly talks about men dressing in women's clothing with the INTENT of looking like or becoming - or taking on the form of - a woman. This verse is about intent. Do women today, wearing women's pants, put them on to look like or to become a man? In general, no. Some do... they are called transvestites (this would be sinful per Deu 22:5). Likewise, some men wear women's clothing to live as women (again, sinful).
Read the verse... it's all about INTENT - I don't know how much clearer it can be - it's plain as day:
Deu 22:5 The woman shall not wear (to exist, that is, be/become) that which pertaineth (something prepared, that is, any apparatus (as an implement, utensil, dress, vessel or weapon): - armour ([-bearer]), artillery, bag, carriage, + furnish, furniture, instrument, jewel, that is made of, X one from another, that which pertaineth, pot, + psaltery, sack, stuff, thing, tool, vessel, ware, weapon...) unto a man (properly a valiant man or warrior), neither shall a man (properly a valiant man or warrior) put on a woman's garment (...assuming the shape of the object beneath...): for all that do so are abomination unto the LORD thy God.
