Sidebar over, West questioning. ME's testimony changed 3 weeks ago. He didn't notify anyone, but says he has notes at his office about the change of opinion.

Yesterday, July 4th, he met with Pros at his [ME's] office. Doesn't remember how long it was. No notes from the meeting.

BAM! West asks about the toxicology report, and the level of marijuana in his system.

Last fall, Wit said level of marijuana would not have any affect on TM....
Now changed to "it could have some mental effect on TM."

WOW!

I hope this is able to be testified to before the Jury. Forgot to say this is just a hearing. Jury is not in the courtroom right now.

Man, Wit just threw Pros under the bus! Said that Pros told him they didn't want to talk about the tox report or marijuana. Dela Rionda is shady! He did NOT want the Wit to mention anything about the tox report or marijuana.

This Wit is unhinged now against the Pros.

Judge is almost yelling at West right now for some reason. West wants to expand the hearing to admissibility.

The Judge is refusing to allow the Def to ask these questions in front of the Jury!!!!

Can anything be done to this Judge? She is being openly biased now for the Pros.

This was a "Richardson Hearing," which means:

A Richardson hearing is a hearing to conduct an inquiry into the surrounding facts and circumstances of an alleged discovery violation.

The claim by West is that the ME gave his deposition and informed them of his opinion last fall; then 3 weeks ago, he changed his opinion regarding the affects of marijuana in TM's system. He met with Dela Rionda? at the ME's office and told him of the change in opinion. The Pros office NEVER INFORMED THE DEFENSE OF THIS!!!

Again....

A Richardson hearing is a hearing to conduct an inquiry into the surrounding facts and circumstances of an alleged discovery violation.

The Judge said there was no Richardson violation. How in the world can that be? The Defense is supposed to be informed of all evidence, facts and circumstances of discovery.

This is infuriating. She should be tossed off the bench.

Man, you missed the show. There was a Richardson Hearing because Def was claiming Pros violated discovery by withholding the information that the ME changed his opinion 3 weeks ago.

The Judge flatly denied there was a violation, and stated that the new information could not be brought up.

Not to be overly dramatic here, but this is indeed a miscarriage of justice. The Judge is deliberately withholding information from the Jury that is crucial to the Def case that TM was impaired by marijuana and it caused him to be aggressive towards GZ.

Now Judge grants a sidebar because Def used the word, "toxicology."

Still upset about the Judge blocking the toxicology report and testimony from the ME that marijuana likely did impair TM.
