Domestic Terrorism Question

If bin laden was an American, who has eluded capture, but was found to be hiding out in Salt Lake City, would it be ok for the government to kill him, once they found him?

Does anyone here remember Waco?
Was Dave Koresh murdered by the American government?

It's interesting that because people wear a uniform, they believe that murder is an appropriate course of action to take in any circumstance.

As a serving member I truly hope to never be in a situation where I'd have to shoot at someone but I would do it if my life or others were in jeopardy. If the person was unarmed, I'd never shoot at them.

But let's say bin laden was a saudi and still alive and hiding out in Salt Lake City....would it still be ok to annihilate him using a drone on American soil?

good article on scope of war on terror. law authorizes war on al qaeda not all terror groups.

Re bin Ladin: as your hypothetical suggests, IF bin laden was a US citizen it would be against the Constitution's 5th, 6th and 8th Amendment to assassinate him. As Rand Paul pointed out, the Constitution [Law] is in place for when democracy fails and someone evil is elected.

n'david I don't know which law gives authority to designate enemy combatants and whether US citizens can be designated. that is the issue of the huffpost article I posted. enemy combatant means you have rejected your constitutional rights.

"Enemy combatant" was only used because Bush wanted to subvert Geneva Conv. and hold "enemy combatants" in Gitmo. I would say it was NEVER meant to include US citizens. However, precedent was set with Bush and has been expanded on by Obama to include US citizens. Yes, I blame W for starting this.
