Presidential Executive Orders

Has anyone here done a study of what powers the Presidential Executive Orders are limited to?

I heard today that VP Biden said that Obama was considering writing an Executive Order on gun control. Didn't give any specifics that I know of.

I do know he has written more orders than any other president and I am guessing he does not have the power to supercede the constitution.

I do think the Congress needs to bring him in check over the using of EO when he doesn't get his way from Congress.

A sitting president cannot write an executive order of any type to supercede the Constitution, it's amendments, or the Bill of Rights.

The only way to change the Constitution is for 2/3 of the states to ratify any changes.

It's a long process and the people are involved in this matter.

Congress knows the power it collectively has, but chooses to look the other way when their constituents constitutional rights are being violated either by them or by a sitting president.

Thank you, I don't know whether to believe it or not. But, that seems reasonable to me. I guess we will have to wait and see who yells the loudest, that's how we know people are right, right?

Wikipedia says 145 which is less than I had read else where. What was surprising was seeing how many other presidents have written.

Executive Orders

In times of emergency, the president can override congress and issue executive orders with almost limitless power. Abraham Lincoln used an executive order in order to fight the Civil War, Woodrow Wilson issued one in order to arm the United States just before it entered World War I, and Franklin Roosevelt approved Japanese internment camps during World War II with an executive order. Many other executive orders are on file and could be enacted at any time.

But ... now there are reparations for the American-Japanese who were unlawfully detained. Our government recognizes that their constitutional rights were violated.
